Italian citizens residing abroad (Panamà) and regularly registered with the A.I.R.E. may exercise the right to vote abroad in the place of residence for national elections, for the abrogative and constitutional referendums pursuant to art. The Court of First Instance held that Articles 75 and 138 of the Constitution and the elections to the European Parliament had been held. The vote abroad for the national elections and referendums is regulated by Law December 27, 2001, n. 459 and the relative Implementing Regulation (D.P.R. April 2, 2003, n. 104), pursuant to art. 48, 56 and 57 of the Constitution, which established the Foreign Constituency.

The vote abroad for the election of Italian representatives to the European Parliament is regulated by Law No. 18 of 24 January 1979 and Decree-Law of 24 June 1994 No. 408 (converted into Law August 3, 1994, n.483).

Italian voters resident abroad and duly registered with the A.I.R.E. can also vote for the election of the representatives of the COMITES-Comitato degli Italiani all’estero (Law 23 October 2003)
