These are in particular:
Authentic signature: The notarial signature (ex art. 1 Notarial Law) can be made, pursuant to art. 28 of D. Lgs. n. 71/2011, only in favor of Italian citizens. The general notion of authenticated subscription is given by art. 2703, paragraph 2, of the Civil Code: “the authentication consists in the attestation by the public official that the subscription has been affixed in his presence. The public official must first ascertain the identity of the person signing”. Pursuant to art. 2702 c.c., the authenticated signature does not confer any character of authenticity to the substance of the act, but proves, until a false claim, its origin.
To proceed with the authentication of the signature, it is necessary to present yourself personally at the Notary Office, by appointment requested by mail consolare.panama@esteri.it indicating in the subject “REQUEST FOR AUTHENTICATION OF SIGNATURE” with an Italian identification document and its tax code; Cost of signing authentication: art. 26 of the table of diritti consolari.
ADMINISTRATIVE AUTHENTICATION OF SIGNATURE:
The D.P.R. 28 December 2000, n. 445 provides that, for Italian or European Union citizens and foreigners residing in Italy (art. 3), the subscription of applications or declarations to be submitted to the Public Administration or public service operators must no longer be certified, but it is sufficient to attach a copy of a valid identity document of the subscriber. The authentic remains necessary, even for the same subjects ex art. In the event of an application being made to private individuals or for the purpose of collecting economic benefits from third parties (for example, in the case of proxies for the withdrawal of pensions, the transfer of ownership of vehicles, the opening of a bank account, etc.). For foreigners not regularly staying in Italy and not citizens of the European Union, the authentic administrative is always necessary.
Differences between notarial authentication and administrative authentication.
- Administrative authentication is characterized by the plurality of subjects entitled to authentication (indicated in art. 21 D.P.R. 445/2000: notary, chancellor, municipal secretary, employee responsible for receiving documentation or other employee appointed by the Mayor)which constitutes an exception to the general principle of notarial jurisdiction.
- Authentic administration is limited to documenting a legal or factual situation, without constituting or modifying it, to reproducing information derived from other already documented acts and has no distinct and autonomous legal effect.
- Moreover, in the notarial document, the official does not merely attest that the signature on the document was affixed in his presence, but checks that the content of the document complies with the law, public order and morality.
Photography Authenticity: It consists in the attestation that a photographic image corresponds to the person of the interested party.
The applicant must show up at the consular office by appointment requested at the following mail consolare.panama@esteri.it indicating in the subject “PHOTO AUTHENTICATION REQUEST” – with a valid identification document and the document or photograph to be certified. The authentication activity is subject to the payment of the fees referred to in the current consular tariff.
