General and special powers

To obtain an appointment with the purpose of signing a power of attorney (Special/General/Notary signature), please write to the address consolare.panama@esteri.it indicating as subject “Request for Proxy” and attaching in Word format copy thereof. The request will be answered promptly with an indication of the appointment.

The power of attorney is the act by which a person (represented) confers on another person (representative) the power to act in his name and account in the performance of legal acts whose effects will arise directly in the person represented.

The powers of attorney are divided into two categories:

General Prosecutor’s Office:
with this act the interested party entrusts the representative with the management of all his affairs, both present and future. The general power of attorney is issued indefinitely and is effective until revoked;

Special power of attorney:
by this act the person concerned entrusts the representative with the management of a specific part of his business. The Special Prosecutor’s Office shall cease to have effect at the time when the particular task for which it was issued ends.

The first paragraph of art. 28 of D.lgs. n. 71/2011 “Organisation and functions of consular offices”, which entered into force on 28 May 2011, prescribes that consular functions in notarial matters may be exercised exclusively against Italian citizens and no longer also against non-citizens, as provided for in the previous legislation. In particular, in the case of foreign nationals (general or special) public prosecutor, the Head of the Consular Office may not exercise his or her notarial skills in this regard, For this reason, foreign citizens who need a power of attorney must go before a notary who will sign and authenticate the same, which must be apostilled and translated and then the signature of the translation will be legalized by the Consulate.

Data and documents necessary to confer a power of attorney 

Italian citizens wishing to sign a proxy (Special/General) should kindly write to consolare.panama@esteri.it indicating in the subject “Request for General/Special Prosecutor’s Office: Name and Surname” and attaching:

  • Draft of the proxy in Word format;
  • Copy of the passport of the represented person and the identity document of the representative;
  • The person concerned must appear at the Embassy on the day of the appointment with the current passport;
  • Payment in cash (art. 17 Procura Generale or art. 18 Procura Speciale), of the Table of consular rights diritti consolari.

Foreign citizens must instead sign a “Poder especial or general” at a Panamanian Notary, apostillarlo on the site of the Panamanian Ministry of Foreign Affairs, https://mire.gob.pa/ministerio/autenticaciones-y-legalizaciones/ and ask for the apostilla of the translation.
