Maintenance and restoration of the surname attributed at birth, abroad, to persons with dual citizenship, Italian and of the foreign country of birth.
The Ministry of the Interior (Directorate of Demographic Services) has specified that requests to change the surname, only to restore it in the form originally attributed at the time of birth abroad, must be processed in accordance with Article 98, paragraph 2 of Presidential Decree 396/2000, i.e. with the correction being made directly by the civil registrar of the municipality where the deed is transcribed.
The aforementioned provisions apply exclusively to foreign-born persons who have held dual nationality (foreign country of birth and Italian nationality) since their birth, or who have had the latter subsequently recognised by derivation from an ascendant, whose surname has been corrected by the civil registrar at the time of transcription of the birth certificate in order to bring it into line with the rules in force in Italy.
